Spain – Court order for payment

Court order for payment in Spain.

In Spain, there is a court order procedure which involves a summons from the Judge to the debtor for the payment of the debt. This procedure can be halted with a simple statement from the debtor claiming the non-existence of the debt or a discrepancy between the claimed debt and the existing debt, according to the debtor’s records.

If there is opposition to debts exceeding € 15,000, an ordinary legal action must be initiated to clarify the situation.

If there is no opposition or no response from the debtor before the Court, the submitted documents (invoices) would become enforceable, and the possibility of initiating seizures would open.
