Installation and Assembly of Systems
There is no specific regulation in Spain that obliges companies installing systems or machinery to register with the Registro de Empresas Acreditadas (REA).
This registry was originally created for the construction sector, but over time the requirement to register has gradually been extended to companies outside that sector.
The regulation states that the activities subject to registration are:

Construction

Assembly and disassembly of prefabricated elements

Conditioning or structures

Transformation

Repair
-
Dismantling

Maintenance
-
Conservation work – painting and cleaning
The fact is that Spanish courts leave the concept open and extend it to activities not directly related to construction.
This is why Spanish companies request Italian suppliers of systems and machinery to register with the REA. Since the terminology is generic, we must rely on reasonable judgment to determine when the work can be considered significant enough to fall within the scope of mandatory registration. In our opinion, the valid criterion should be the risk of injury.
For example, a simple repair of a machine is not the same as repairing an industrial furnace. Likewise, a basic assembly is different from one that involves handling heavy panels.
Our recommendation is to register with the REA if the work to be carried out in Spain involves the handling of heavy elements, use of scaffolding or cranes, work at height, electrical installations, or similar activities.
