Construction Sector in Spain

Spanish companies in the Construction Sector cannot manage occupational risk prevention through the Employer and must contract an external service. This requirement is imposed by the Convenio Colectivo del Sector de la Construcción, which is considered mandatory for all companies operating in the Construction Sector in Spain, including foreign companies in the case of posted workers in Spain.

The Registro de Empresas Acreditadas (REA) therefore considers this aspect a requirement for registration.

This requirement may thus be requested by Spanish client companies to foreign companies, which is why they must demonstrate that they have:

  • Contracted an external service (either in their country of residence or, alternatively, a local Spanish service);

  • Trained posted workers on the following risks:

There are five blocks of occupational risks in the construction sector:

  1. Fall risk: includes hazards related to working at heights, such as falls from scaffolding, ladders, roofs, or other elevated places.

  2. Trapping or crushing risk: refers to situations where workers may become trapped between machinery, heavy equipment, or collapsing structures.

  3. Manual handling risk: involves the possibility of musculoskeletal injuries due to incorrect handling or overloading when lifting, carrying, or loading heavy objects.

  4. Exposure to hazardous substances: includes exposure to chemicals, dust, fumes, gases, or toxic materials present in the workplace, which can have adverse health effects.

  5. Electrical risk: refers to the possibility of electrocution or electric shocks due to the use of electrical equipment on the construction site, as well as exposure to faulty wiring or electrical installations.

These blocks represent some of the most common risks in the Construction Sector, but it is important to note that other specific risks may exist depending on the type of project and the activities carried out.
