Spain – Free Depreciation for Investments in Electrical Self-Consumption facilities

Royal Decree-Law 7/2026, of March 20, approving the Comprehensive Response Plan to the Crisis in the Middle East, has introduced a measure allowing free depreciation for investments in electrical self-consumption installations using renewable energy. This includes thermal installations (heating/cooling) for own consumption using renewable sources, provided that they:

  • Replace fossil energy
  • Enter into operation in 2023, 2024, 2025, or 2026

Examples: solar panels, biomass, geothermal energy, efficient heat pumps, etc.

Free depreciation will apply in the tax period corresponding to the year in which the installation becomes operational:

  • 2023 → depreciation in 2023
  • 2024 → depreciation in 2024
  • 2025 → depreciation in 2025
  • 2026 → depreciation in 2026

The following requirement is established:

  • Maintain the average workforce for 24 months, compared to the 12 months prior to the investment.

If this requirement is not met, the tax benefit must be repaid with interest.

The maximum amount of investment eligible for the free depreciation regime will be €500,000.

The following will not be eligible for this measure:

  • Buildings
  • Installations required by regulation (except for any excess above the minimum required)
