Posting Notifications

The issue that arises when attempting to submit posting notifications for workers in Spain is well known. In fact, this matter has been delegated to regional governments, and many of them have decided to create their own platforms to manage this and other related matters—consciously increasing public spending. It is worth noting that the Ministry of Labor already has a platform that would be perfectly suitable for handling these notifications, but the regional governments feel the need to spend indiscriminately in order to maintain their expenditure levels and justify their requests for funding for the following year.

That said, below is a list of the information required in the notification:

  • Identifying details of the posting company, including tax residence and VAT number.

  • Location of the construction site.

  • Identifying details of the posted workers.

  • Identifying details of the contracting company in Spain (indicating whether it is a direct contract or a subcontract).

  • Start date and expected duration of the posting.

  • Description of the services the worker will provide in Spain.

  • Identifying details of a physical or legal person appointed by the posting company as a representative with a presence in Spain, to serve as a liaison with the Spanish authorities and to send/receive documents and notifications if necessary. Our firm would act as the contact person.

  • Identifying details of the representative of the posting company responsible for procedures related to information and negotiation with the posted workers in Spain.

Companies wishing to submit posting notifications face the issue that their electronic signatures are currently incompatible with the Spanish platforms. As a result, they must contact consultancy firms or use other means to submit the notifications.
